  • Consent language specifies: company name, that messages may be sent using automated technology, that consent is not a condition of purchase, message frequency, and "msg & data rates may apply."
  • Timestamp, IP, and form snapshot stored for every opt-in. I recommend keeping these for at least 4 years (TCPA statute of limitations is 4 years).
  • Skip-trace lists are not consent. Just because you have a phone number from a county record or list broker does not mean you can text it for marketing purposes. This is where most investors get in trouble.

Message Content

  • Identification - first message in any new conversation identifies your company.
  • Opt-out instructions - "Reply STOP to opt out" in the first message and at minimum every 30 days after.
  • No misleading content - no fake "Re:" prefixes, no pretending to be a neighbor, no fake personal names if you're an AI.
  • AI disclosure when asked - if a lead asks "are you a real person?" the agent should say no. (More on this below.)

Operational Guardrails

  • Time-of-day enforcement - no texts before 8:00 AM or after 9:00 PM in the recipient's local time zone. Some states are stricter.
  • DNC scrub - federal and state Do Not Call lists scrubbed weekly.

  • Reassigned Number Database (RND) check - RND tells you if a number has been reassigned since you got consent.

Two things to call out. First, "cold opted-in" is doing a lot of work in that table. There's no such thing as compliant cold SMS to a list you bought without explicit prior express written consent. Those reply rates are for lists where the lead opted in through a landing page or partner co-reg flow. Second, the contract conversion number is the one I'd weight most - high reply rates with no contracts means your AI is great at chatting and bad at qualifying.

How the AI SMS Real Estate Agent Actually Works End-to-End

Here's the flow on a typical inbound seller lead, start to finish:

  1. Lead submits form with compliant opt-in checkbox. TrustedForm certificate generated. Metadata posted to Customer.io.
  2. Customer.io fires a "new_lead" event that triggers an immediate SMS via Twilio.
  3. Lead replies. Twilio webhook hits our middleware (n8n or a small Next.js API route).

Common AI SMS Real Estate Mistakes I See (and How to Avoid Them)

Texting skip-traced numbers without consent. This is the single biggest TCPA risk in the wholesaling industry. A skip-traced phone number is not consent. If you want to reach those leads, send compliant direct mail or ringless voicemail with a clear opt-in CTA, then text only after they opt in.

Using a personal cell number to "test." Personal numbers aren't registered for A2P traffic. Carriers will throttle or block you, and any complaint goes directly to your personal name.

Pretending the AI is a human. Beyond the ethical problem, several state attorneys general (California, Colorado, Utah) now require AI disclosure on demand. Just be honest - leads actually appreciate it.

Ignoring time zones. A lead with a 305 area code may live in Oregon. Use the address (or IP at opt-in), not the area code.

Skipping the warm-up period. New 10DLC numbers should ramp from 50 to 500 to 5,000 messages per day over 2–3 weeks. Going from 0 to full volume on day one tanks deliverability and never recovers.

No human escalation path. AI is great at qualification and scheduling. It is not great at delicate seller situations - probate, divorce, financial distress. Build an explicit "escalate to human" trigger when sentiment goes negative.

A Realistic 30-Day AI SMS Real Estate Rollout
